Terms of Service

These Terms govern your use of the mobile games and related services (the “Service”) provided by Oniberry Games (“Company”, “we”), and set out the rights, obligations, and responsibilities between the Company and users.

1. Purpose

These Terms define the basic matters regarding the rights, obligations, and responsibilities of the Company and users, and the conditions and procedures for using the Service.

2. Definitions

• “Service” means the mobile game applications and all incidental services provided by the Company.
• “User” means anyone who uses the Service under these Terms.
• “Account” means the usage credential created or linked via Google or Apple sign-in for identification and use of the Service, and includes “Guest” use without separate sign-in.
• “Content” means all materials provided within the Service, including games, items, images, and text.

3. Posting and Amendment of Terms

• We post these Terms within the Service or on our website so users can review them.
• We may amend these Terms within the limits of applicable law. For amendments, we announce the effective date and reason at least 7 days in advance (30 days for changes unfavorable or material to users).
• If you continue to use the Service after the effective date of the amended Terms, you are deemed to have agreed to them.

4. Interpretation

Matters not specified in these Terms and their interpretation are governed by applicable laws and commercial practice.

5. Provision and Change of Service

• We provide the Service 24 hours a day, year-round, in principle.
• We may change the content of the Service for operational or technical reasons, and announce material changes in advance.
• Some or all of the free Service may be modified, suspended, or changed according to Company policy.

6. Suspension of Service

• We may temporarily suspend all or part of the Service in cases of system maintenance, replacement, breakdown, loss of communication, or force majeure such as natural disasters.
• Unless otherwise provided by law, we are not liable for suspension of the Service due to such causes.

7. Accounts and Management

• You may use the Service by linking an account via Google or Apple sign-in, or as a Guest.
• You are responsible for managing your account and linked information and must not allow third parties to use it.
• For Guest use, game data may be lost due to device change or app deletion, and we are not obligated to recover such data.

8. User Obligations

You must not engage in any of the following:

• Misappropriating others’ information or using the Service by improper means
• Reverse engineering, extracting source code, hacking, or using abnormal programs (cheats, macros, etc.)
• Interfering with the normal operation of the Service
• Infringing the intellectual property rights of the Company or third parties
• Posting obscene, violent, or otherwise objectionable information
• Any other acts violating applicable law or these Terms

9. Paid Services and Payment

• We may provide paid items (“Paid Content”) within the Service, and payments are made through the in-app purchase systems of Google Play or the App Store.
• The price, content, and conditions of Paid Content are displayed within the Service at the time of purchase.
• Payment and billing follow each store’s policies, and payment method information is managed by the respective store.

10. Withdrawal and Refunds

• You may withdraw a purchase in accordance with applicable laws, including the Act on Consumer Protection in Electronic Commerce.
• However, for digital content whose value is significantly diminished by immediate use or application (e.g., already-used in-game goods or items), withdrawal may be restricted under applicable law.
• Refunds for in-app purchases are, in principle, handled according to the refund policies and procedures of Google Play and the App Store, and you may request refunds through the respective store.

11. Content and Intellectual Property

• Copyright and intellectual property rights in the Service and its Content belong to the Company.
• You must not reproduce, distribute, transmit, create derivative works from, or otherwise use the Content without the Company’s prior consent, nor allow third parties to do so.

12. Cloud Save Service

• When you link an account, your game progress data may be stored and synchronized in the cloud.
• When used across multiple devices, data may be synchronized based on the most recent or most-progressed data.
• We are not liable for data loss arising from causes other than our willful misconduct or gross negligence, and deleted data may not be recoverable.

13. Protection of Personal Information

We protect users’ personal information as required by law. Matters concerning the processing of personal information are governed by our separate Privacy Policy.

14. Disclaimer and Limitation of Liability

• We are not liable for service disruptions caused by force majeure or by causes attributable to the user.
• Unless otherwise provided by law, we are not liable in connection with the use of services provided free of charge.
• We are not liable for any profits expected or lost by users through the Service.

15. Governing Law and Disputes

• These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
• Any lawsuit regarding disputes between the Company and users shall be filed with the competent court under the Civil Procedure Act.
